Agreement to Terms

By accessing or using the VOX AI website, mobile applications, or any services provided by Vox AI B.V. (collectively, the "Services"), you agree to be bound by these Terms of Use. If you do not agree to these Terms, you may not access or use the Services. These Terms of Use constitute a legally binding agreement between you and Vox AI B.V., registered at Keizersgracht 241, 1016 EA Amsterdam, the Netherlands.

Description of Services

VOX AI provides AI-powered voice solutions for drive-thru and other quick service applications ("Drive-Thru 2.0"). Our Services may include software, applications, APIs, and other tools designed to improve customer service efficiency and quality through artificial intelligence and voice recognition technology. We reserve the right to modify, suspend or discontinue any part of our Services at any time.

User Accounts and Registration

Some portions of our Services may require you to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by VOX AI, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. These Terms permit you to use the Services for your personal, non-commercial use only. No right, title, or interest in or to the Services or any content on the Services is transferred to you.

Acceptable Use Policy

You agree not to use the Services: (a) In any way that violates applicable laws or regulations; (b) To transmit any material that contains viruses, trojan horses, or other harmful code; (c) To attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Services; (d) To collect or track information about others; (e) To impersonate another person; (f) To engage in any other conduct that restricts or inhibits anyone's use of the Services, or which may harm VOX AI or users of the Services.

By using our Services, you consent to our collection, use, and processing of your data as described in our Privacy Policy. We implement cookies and similar technologies as described in our Cookie Policy, which is part of our Privacy Policy.

The Services may contain links to third-party websites or services that are not owned or controlled by VOX AI. We have no control over, and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that VOX AI shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such content, goods, or services available on or through any such websites or services.

Limitation of Liability

To the maximum extent permitted by applicable law, VOX AI and its officers, directors, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your access to or use of or inability to access or use the Services. The foregoing limitations will apply regardless of whether such damage arises out of breach of contract, tort, or otherwise and regardless of whether VOX AI has been advised of the possibility of such damages.

Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. VOX AI disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. VOX AI does not warrant that the Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Services or the server that makes them available are free of viruses or other harmful components.

Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us for assistance.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Services shall be exclusively brought in the courts of Amsterdam, the Netherlands, and you consent to the personal jurisdiction of such courts.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised Terms.

Entire Agreement

These Terms constitute the entire agreement between you and VOX AI regarding the use of the Services, superseding any prior agreements between you and VOX AI relating to the Services. These Terms may only be modified in writing or by VOX AI posting changes to these Terms on its website.
